TERMS OF SERVICE & END USER LICENSE AGREEMENT (EULA) – JOISE

1. Who we are and what these Terms cover
These Terms of Service (“Terms”) are an agreement between you and Infinicode Patrycja Rychlik-Widera, doing business as Joise (“Joise,” “we,” “us”).
They govern your use of:

the Joise iOS app (including beta versions),
-
any related services, content, and features,
-
our website https://www.joise.app (as applicable).
By downloading, accessing, or using Joise, you agree to these Terms.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live) to use Joise.
You may use the app only if you are legally permitted to do so in your country of residence. If you are under the age at which you can legally agree to these Terms, your parent or legal guardian must review and accept them on your behalf.
3. Accounts
You may need an account to use certain features.
You agree to:

provide accurate information,

keep your login credentials secure,

notify us of unauthorized access.
We may suspend or terminate accounts that violate these Terms.
4. Health disclaimer (important)
Joise provides planning and informational tools only. Joise is not a medical device and does not provide medical advice, diagnosis, or treatment.
Always seek advice from a qualified healthcare professional for medical concerns. Do not ignore professional advice because of information from Joise.
5. Apple Health / HealthKit and permissions
If you choose to connect Apple Health / HealthKit, you authorize Joise to access the data types you select. You can revoke access at any time in iOS settings.
6. Subscriptions, trials, and billing
Joise may offer paid features via Apple In-App Purchase.

Prices, billing period, and trial terms (if any) are shown at purchase time.

Apple manages payment processing and billing.

You can manage or cancel subscriptions in your Apple ID account settings.

Unless required by law, payments are non-refundable once processed, except as provided by Apple’s policies and applicable consumer laws.
7. License and acceptable use
License. Subject to these Terms, Joise grants you a personal, non-exclusive, non-transferable, revocable license to use the app for your own personal, non-commercial use.
You may not:

reverse engineer, decompile, or attempt to extract source code (except where permitted by law),

copy, modify, or create derivative works of the app,
-
use the app to violate any law or third-party rights,
-
interfere with security or operation of the Service,
-
access the Service via automated means except as permitted.
8. Your content
You may input content such as symptoms, notes, schedules, and other information (“User Content”).

You retain ownership of your User Content.

You grant Joise a license to host, store, process, and display User Content solely to provide and improve the Service.

You are responsible for your User Content and must not upload unlawful or infringing content.
9. Intellectual property
Joise and its content (excluding User Content) are owned by Joise or its licensors and protected by IP laws. These Terms do not grant you any ownership rights.
10. Third-party services and links
The Service may rely on third-party services (e.g., Apple Health, hosting providers, analytics).
We are not responsible for third-party services outside our control. Your use of third-party services may be governed by their terms.
11. Beta features
Some features may be labeled beta/preview and may change or be discontinued. Beta features are provided “as is,” and you use them at your own risk.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if required for security/legal reasons.

13. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation, or that forecasts will be accurate for your situation.
14. Limitation of liability
To the maximum extent permitted by law:

Joise will not be liable for indirect, incidental, special, consequential, or punitive damages.

Joise’s total liability for any claim related to the Service will not exceed the amount you paid to Joise (via Apple) for the Service in the 12 months before the event giving rise to the claim (or USD/EUR 50 if you paid nothing), whichever is greater.
Important: Nothing in these Terms limits liability where it cannot be limited under applicable law (e.g., certain consumer rights, intentional misconduct, or personal injury caused by negligence, where prohibited).
15. Consumer rights (EEA/UK)
If you are a consumer in the EEA/UK, you may have mandatory rights under consumer protection laws. These Terms do not limit those rights.
16. Governing law and disputes
These Terms are governed by the laws of Poland, without regard to conflict-of-law rules.
If you are a consumer, you may also benefit from mandatory protections of your country of residence.
Courts: Unless mandatory law provides otherwise, disputes will be submitted to the competent courts in Poland.
17. Changes to these Terms
We may update these Terms. If changes are material, we will provide notice in the app and/or website. Continued use after the effective date means you accept the updated Terms.

19. Apple platform terms (iOS EULA addendum)
If you downloaded the app from Apple’s App Store:

These Terms are between you and Joise, not Apple. Apple has no responsibility for the app except as required by applicable law.

Apple (and Apple’s subsidiaries) are third-party beneficiaries of this EULA and may enforce it against you.

Apple’s Standard EULA may apply unless Joise provides a custom EULA in App Store Connect.
